Terms of Use
These Terms of Use (the “Terms”) are an agreement between you and the developer of Uncloud (“Uncloud”, “we”, “us”). They cover the Uncloud app for Mac and the website at getuncloud.vercel.app (together, the “Service”). By using the Service, you agree to these Terms. If you don’t agree, don’t use the Service.
1. Not affiliated with Apple
Uncloud is an independent app. It is not affiliated with, endorsed, sponsored, or approved by Apple Inc. Apple, iCloud, iCloud Photos, iPhone, Mac and macOS are trademarks of Apple Inc., registered in the U.S. and other countries and regions. We use these names only to describe what Uncloud works with.
2. What Uncloud does
Uncloud runs on your Mac. It can:
- export your photos and videos from iCloud Photos, or from Photos on your Mac, to a drive you choose
- back up new photos automatically when your drive is connected
- let you browse your backup by date, place and map
- delete photos from your iCloud library, but only after you select them and confirm
Uncloud is free. There are no paid plans.
3. No Uncloud account
Uncloud doesn’t need an Uncloud account. Some earlier test versions asked you to create one with your email address. If you created one, email us and we’ll delete it. You must be at least 13 years old to use Uncloud.
4. Your Apple account and iCloud
To export from iCloud, you sign in to your Apple account inside Uncloud. When you do:
- Uncloud talks to Apple directly from your Mac, the same way iCloud.com does in a web browser.
- Your Apple account password and session are kept on your Mac, in the macOS Keychain and the app’s own storage. They are never sent to us.
- You are responsible for following Apple’s terms for your Apple account and iCloud.
- Apple can change or limit how iCloud works at any time, without notice to us. If it does, parts of Uncloud may stop working, slow down, or be limited by Apple, for example by throttling downloads. We aren’t responsible for Apple’s services or for changes Apple makes.
5. Your photos and your backup
Your photos go straight from Apple, or from Photos on your Mac, to the drive you choose. They never pass through our servers, and we can’t see them. You keep all rights in your photos. You are responsible for:
- choosing, keeping and protecting your backup drive
- checking that your backup is complete and readable before you rely on it
- keeping more than one copy of anything you can’t afford to lose
6. Deleting from iCloud
Delete from iCloud permanently changes your iCloud library. Uncloud only deletes photos you select, and only after you confirm. Photos you delete:
- are removed from iCloud on all your devices that use iCloud Photos
- move to Recently Deleted, where Apple keeps them for about 30 days before removing them for good
Uncloud shows which photos it has recorded as backed up, but you decide what to delete. Before you delete anything, make sure your backup has what you need. We are not responsible for photos you choose to delete.
7. Acceptable use
Don’t use the Service to:
- access an Apple account or photos that aren’t yours or that you aren’t authorized to access
- break the law or anyone else’s rights
- overload, probe or attack our servers
- resell the Service
Uncloud’s source code is published on GitHub under its own license. That license governs your use of the code. These Terms govern your use of the Service.
8. Test builds
Uncloud is in active development. Builds may not be notarized by Apple and may contain bugs. Features may change or be removed.
9. No warranty
The Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, whether express or implied, including:
- merchantability
- fitness for a particular purpose
- non-infringement
- that the Service will be uninterrupted, error-free, or will export or keep every photo
10. Limitation of liability
To the fullest extent the law allows, we are not liable for:
- any indirect, incidental, special, consequential or punitive damages
- any loss of data, photos, profits or goodwill arising from your use of, or inability to use, the Service
This applies even if we were told such damages were possible. Our total liability for any claim relating to the Service is limited to 50 Canadian dollars. Some places don’t allow these limits. Where they don’t, they apply only as far as the law allows.
11. Indemnity
You agree to hold us harmless from claims arising from:
- your misuse of the Service
- your breach of these Terms
- your use of an Apple account you aren’t authorized to use
12. Ending the Service
You can stop using Uncloud at any time by deleting the app. We may change or discontinue the Service. If we do, the copy of Uncloud you have may keep working, but it won’t get updates. The photos already on your drive stay yours and stay where they are.
13. Changes to these Terms
We may update these Terms. When we do, we’ll change the date above. If a change is significant, we’ll also tell you in the app or by email. If you keep using the Service after a change, you accept the new Terms.
14. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. Disputes go to the courts of Ontario, unless the law where you live gives you the right to bring them in your local courts.
